USER CONSENT OF THE TERMS

You represent and warrant that you have read, understand and agree to be bound by the Terms, which constitute a legal agreement between you and YARROW. You represent and warrant that you have full authority to accept the Terms. If you are accepting on behalf of someone else, you represent and warrant that you have full legal authority to bind that person or entity to these Terms. If you do not have full legal authority to bind your entity to the Terms, please ensure that an authorized person from your entity consents to and accepts the Terms, otherwise you are prohibited from accessing, linking to or using this Site.

 

DESCRIPTION OF PRODUCTS

All products available for purchase are described on their specific product page on our website. Apex Marketing & Services (S) Pte Ltd always try to represent as accurately as possible every characteristic of the products via photographs provided by designers, suppliers or manufacturers. We strive to provide you with the best images and description, but we cannot guarantee that colours and details in website images are 100% accurate representations of the product, and sizes might in some cases be approximate.

 

PAYMENT TERMS

Apex Marketing & Services (S) Pte Ltd accept only payment via Visa/Mastercard, (Paypal) and through PayNow. Apex Marketing & Services (S) Pte Ltd is not responsible for the errors, acts and omissions of the credit card companies.

Apex Marketing & Services (S) Pte Ltd requires full payment before a delivery can be made. A credit card and necessary information is needed for payment. All orders are paid only through PayNow, PayPal account or by credit cards issued by companies listed on the payment page. Payment will be charged to your credit card or PayPal account at the time when your order is accepted. Your order will be submitted for processing as soon as you click on the “confirm” button. We will send an electronic receipt to your e-mail address once your payment has been approved, with the availability of the product and the expected date of delivery. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or by reason of unwinding or suspending any transaction after processing has begun.

All prices are subject to taxes, unless otherwise stated. We reserve the right to amend the price of any product at any time without giving any reason or prior notice. Please complete payment at the moment your order was placed as all unpaid orders will be cancelled automatically after an hour. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we deliver your order.

 

WARRANTY

The Site, its services and all information provided herein are provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied, other than those imposed by law, including but not limited to warranties of title or implied warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement.

Without limiting the generality of the foregoing, we expressly disclaim any warranty, condition, guarantee, term or representation (i) as to the reliability, accuracy, completeness, and validity of any content or material on the Site; (ii) that the functions contained on the Site will be secure, uninterrupted or error-free; and (iii) that any defects will be corrected. Any and all such warranties, conditions, terms and representations are specifically excluded. We assume no responsibility for errors or omissions in the materials on the Site, including factual or other inaccuracies or typographical errors. You expressly agree that your use and/or access of the Site is at your sole risk.

 No warranty shall be granted for incidents arising from unforeseeable circumstances or events of force majeure, or for replacements or repairs resulting from normal wear and tear to the material, deteriorations or accidents resulting from malicious or negligent acts, faulty installation, surveillance or maintenance, or use that is abnormal or does not comply with YARROW’s instructions.

 Apex Marketing & Services (S) Pte Ltd shall in no event be responsible for any direct, indirect, accident, consequential or incidental damages such as (but not limited to) loss of expenses, sales or profit, loss of value which could have been created by the use of products. The responsibility of Apex Marketing & Services (S) Pte Ltd shall never exceed the repair or replacement cost of the products or part thereof which gives rise to claim.

 While we take every step possible to handle your merchandise with care, occasionally damage does occur during shipping or handling. Please inspect your purchase promptly after you receive it and report any visible damage within 7 days to Apex Marketing & Services (S) Pte Ltd. One of our friendly staff will arrange to have the damaged item returned to the store and a replacement will be dispatched as soon as possible. We may require proof of damage from you by way of a photograph to help us assess the damage and facilitate a repair, replacement or refund of the damaged goods.

If the model originally purchased cannot be repaired or replaced, an equivalent model will be offered. Should a replacement not be available, we will issue a Apex Marketing & Services (S) Pte Ltd cash voucher worth the value of the item purchased. Damaged goods must be returned in the same condition as when received by you with all original packaging. At all times, we operate in good faith and trust you will also accept our terms and conditions throughout on the same basis. Ultimately, we always aim to make your purchase and delivery of goods a simple and pleasant experience .

DELIVERY

Apex Marketing & Services (S) Pte Ltd offers free delivery on qualifying orders above $200.00 which is only applicable within Singapore mainland. For non-qualifying orders, the cost of delivery of your Order will be displayed to you on our Site. Orders are processed and dispatched from our warehouse to our local delivery partner within an estimated 3 – 5 working days. Our local delivery partner shall deliver the product to the address specified in your Order. Any delivery dates stated during the order process are estimates only. If the goods cannot be delivered on your preferred delivery date and/or time-slot due to reasons such as lack of stock from suppliers or scheduling difficulties, you will be notified the soonest possible. Apex Marketing & Services (S) Pte Ltd reserves the right to amend the delivery timings or to substitute the original item to a similar product of higher or equal value should such circumstances arise. The time for delivery shall not be of the essence, and neither we nor our agents shall be liable for any delay in delivery howsoever caused.

 

**Please be aware there are no deliveries on eve of public holidays and public holidays.

 ***No items shall be delivered until they are paid in full.

 

Our staff will be pleased to contact you within 24hrs before delivery to confirm your delivery details and timing. At this point, it is important to generally ascertain the specific needs and possible surcharges that may need to be applied upon delivery, so that every purchase is concluded in a fair and fuss-free manner. If you are not home to receive the goods, they may need to return your goods to the store and another delivery will be arranged at an additional cost of $30.00/trip.

 Delivery lead time may vary depending on the products ordered. Our on-demand production model makes it vary from 2 to 16 weeks on average. This is only an average estimation, and some delivery can take longer, or alternatively be delivered much faster. All delivery estimates given at the time of placing and confirming order are subject to change. In any case, we will do our best to contact you and advise you of all changes.

 

RETURN POLICY

Apex Marketing & Services (S) Pte Ltd must be contacted prior to any arrangement being made with regards to returning any product in line with our return policy.

1) We must be notified of any exchange/return within 7 days from the Order Date. If your request is approved, it must be completed within the next 7 working days. Request for exchange therefore will not be entertained.

2) Any item must be returned in original conditions. Returned items not received in their original state will be returned to the customer (delivery fees applicable). We reserve the rights to reject a return if it is not in its original conditions.

3) Any exchange/return will be one-time and will not be applicable for a second exchange.

4) If any replacement piece is out of stock at the point of receipt, store credit will be issued.

5) Customers will be fully responsible for the fees incurred for the exchange or return.

6) Please wait for further instructions before mailing any parcel back to us.

Customers must present their delivery receipt when requesting an exchange. Exchanges cannot be made for product that is damaged resulting from misuse, abuse or normal wear and tear.

All products qualify for a return except for the following:

Customised products
Clearance/1 SET OFFER/AS-IS products
Products that require on-site assembly
Products that are not in its new and original unopened condition
Products that have been removed from their original packaging, used, stained, torn, washed, discoloured, dented, damaged and/or with traces of fragrance or odours
Products should be unused, undamaged, in a resalable condition and with its original packaging fully intact. Apex Marketing & Services (S) Pte. Ltd. has the full discretion to decide whether any item is in a condition suitable for return and reserves the right to reject any returns if they are deemed unfit for return.

Please choose carefully as every refund/cancellation will incur a S$80.00 admin/delivery fee.

The full refund amount will exclude any delivery, assembly, delivery timing, delivery location and/or staircase delivery fees paid when the original order was made.

Clearance Items: There will be strictly no returns, refunds, exchanges or warranties for items which are under clearance unless otherwise stated.

The product descriptions of clearance items will clearly state their defects (if any).

 

INCORRECT ITEMS

If you believe you have received the wrong item, email contact@yarrow.sg with your order number, and a photograph of the item. We may ask you to proceed with sending your item back to us, for which your postage will be reimbursed. The maximum refund for postage costs will be the costs of delivery by the least expensive delivery method we offer.

Please note that items must be unused, unopened, unaltered, and with its labels intact. If the correct item is no longer in-stock, store credit or refund will be issued instead.

 

INDEMNITIES

You agree to indemnify us and hold us and our partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives harmless from any claims, losses, and damages, including reasonable attorneys’ fees, arising out of:

  1. Your access of, use of and/or participation in this Site;
  2. Breaches of your obligations under these T&Cs;
  3. Your violation of any rights of another person or entity; and/or
  4. Your breach of any statutory requirement, duty or law.

 

INTELLECTUAL PROPERTY RIGHTS

This Site may contain links to web sites controlled or offered by third parties (non-affiliates of YARROW). The links are only provided as a convenience and YARROW does not endorse or recommend any products or services offered by or information contained in any of these third-party sites. YARROW hereby disclaims all liability for all information, materials, products or services posted, offered or that may be accessed at any of the third-party sites linked to this Site. YARROW makes no representation regarding the quality of any product or service contained at any such third-party site. Furthermore, YARROW hereby disclaims all liability for any failure of products or services offered or advertised at those third-party sites.

 

WHEN YOU BECOME RESPONSIBLE FOR THE PRODUCT

The product will be your responsibility from the time we deliver the product to the address you provided to us. You own the product which is the subject of your Order once we have received payment in full for your Order.

 

TERMINATION

YARROW reserves the right to terminate your access to the Site or account for any reason, including without limitation, violation of applicable laws or breach of these Terms. You agree that any termination of your account may be effected without prior notice. You further acknowledge that YARROW will not be liable to you for any termination of your access to or use of the Site.
